Summers can get quite hot, and one of the best ways to relax and cool off is by jumping into water. Whether a lake, a swimming pool, or the ocean, there are many places to escape the heat in North Carolina. Unfortunately, drowning accidents can and do happen all too often. Swimming, boating, and other water activities can be dangerous. There are about 4,000 unintentional drowning deaths every year in the United States, according to the Centers for Disease Control and Prevention (CDC).
In this crucial video, Managing Member Matt Arnold of Arnold & Smith PLLC addresses the alarming issue of summer drowning accidents.
Drowning and Near Drowning
Drowning happens when a person is submerged in the water and unable to breathe air. A person can only hold their breath for a few minutes at the most. Most drownings happen in just a matter of minutes. A near-drowning is when someone takes in water but is rescued and survives. Dry drowning can happen after a near drowning, due to larynx spasms that close the airway after a near-drowning.
Water Safety
Drownings can be prevented. There are many things that people can do to improve safety while swimming or participating in activities in the water. Parents should always closely supervise children while they are swimming. Provide swimming lessons to your children to help them cope with situations that may occur in the water. Always wear a life vest while on a boat since it will allow you to float more easily and keep your head above water in many cases. Don’t swim or boat alone. Don’t drink alcohol while boating, and follow all water safety rules.
If you own a family pool, make sure you have a fence and locked gate to keep others from entering unsupervised. Keep the ladder locked away from an above-ground pool so children cannot access it unattended. Have a life preserver ready to use at your pool. Have your phone ready to use in case of an emergency. Learn CPR so you can rescue someone very quickly if an accident happens. When visiting a community or hotel pool, always check for the presence of lifeguards and ensure that you always keep an eye on your child.
Negligent Drownings
Sometimes, drowning is not caused by negligence. However, there are times when the negligence of another results in a drowning or near-drowning. A negligent act is one that occurs when someone fails to take regular care and causes an injury. A pool owner or operator might be responsible for drowning if they were negligent. Some common types of pool negligence include improper maintenance, inadequate supervision, lack of proper safety equipment or devices, not having safety equipment available, and not properly securing pool access.
If you or your child was hurt or died as a result of negligence, you may be able to seek damages from the negligent party. You may be entitled to compensation for medical bills, rehabilitation and care costs, lost wages, pain and suffering, loss of consortium, and more.
