Charlotte Injury Lawyer Matt Arnold answers the question: “Should I file the property damage claim with the at-fault driver’s insurance company or with my insurance company?”
Chances are you have driven through a town equipped with red light cameras to catch drivers who run red lights and to prevent more drivers from running red lights. These cameras are part of a safety initiative to make the roads safer for all parties. A red light camera can be beneficial in that if a driver receives a ticket for a red light violation once, he or she might be deterred from doing it in the future. Additionally, other drivers might know of the existence of the cameras and not want to risk receiving a fine for running a red light, so they avoid running lights altogether. While red light cameras offer a variety of safety benefits such as protecting pedestrians, protecting cars crossing through an intersection, etc., there are some downsides, as well.
One such downside of red light cameras is that when a driver encounters a red light camera when approaching an intersection, he or she is more likely to slam on the brakes suddenly instead of continuing through the intersection. Drivers behind that car might have thought that there was time for both to proceed through the intersection and are therefore unprepared to stop quickly. This can result in rear-end collisions that can severely injure all parties involved.
A study conducted by the Federal Highway Association found that the rate of right angle crashes, commonly referred to T-bone accidents, has decreased in areas implementing red light cameras. This same study found that the rate of rear-end collisions has increased in these areas because drivers are more likely to slam on their brakes.
Injuries incurred in rear-end collisions can be quite serious. Common injuries include concussion, whiplash, soft tissue issues, hernias, and even traumatic brain injury. These injuries can result in thousands of dollars of medical bills. Even if immediately following the accident you do not think that you are injured, it is imperative that you seek medical attention to receive a thorough check up to check for any undiagnosed injuries.
Every car accident is different, and each case must be looked at independently. Usually, each party of a car accident wants to hold the other driver responsible. In a rear-end collision, it might seem like the car that rams into the back of the other is guaranteed to be the one responsible. However, in terms of a personal injury suit to recover damages, there is the possibility to recover damages, even if you were the car hitting the other car. Each situation is different and an experienced attorney can examine the case and make a recommendation.
