What Kinds of Fireworks are Legal in North Carolina?

North Carolina law allows the public to use only certain types of fireworks. The legal kinds of fireworks include those that do not leave the ground, those that don’t explode, and those that don’t spin. A firework that explodes or flies up into the air is not legal to possess or use in North Carolina. Generally, fireworks that are classified as novelty fireworks that you can purchase legally from vendors in the state are allowed. Sparklers and fountains are considered legal because they do not explode, nor do they leave the ground.

Illegal Fireworks

Many types of fireworks are illegal in North Carolina. Typically, these are fireworks that you must purchase out of state or from an illegal vendor. Some types of illegal fireworks are firecrackers, bottle rockets, Roman candles, and any other fireworks that you shoot off into the air. These are illegal, regardless of the amount of charge or size of explosion they make. These types of fireworks are considered dangerous, and they are basically unregulated because they are illegal. These types of fireworks can cause serious bodily injury.

It is illegal to manufacture, sell, or use pyrotechnics without the proper license and insurance. Only a qualified display operator is allowed to handle pyrotechnics, such as those at an event or public exhibition. A permit is required to display fireworks in public. The fire marshall must inspect the premises and ensure that the operator has proper licensing. The licensed operator must be present when the fireworks are present and when they are being set off. They must supervise and oversee the display at all times.
