Early Morning Crash Leaves One Driver Dead

An early morning crash in east Charlotte resulted in the death of one of the drivers. The accident happened at about 5:00 am between two pickup trucks. The deadly accident occurred at the intersection of Hood Road and Plaza Road Extension. The accident occurred between two pickup trucks. Unfortunately, the crash resulted in one fatality.

Early Morning Crash

The Charlotte-Mecklenburg police department responded to the accident at about 5 am. They found two Ford pickup trucks that had been involved in a crash at the intersection. The crash happened near Reedy Creek Elementary School, although school was not in session at the time. Both pickup trucks sustained extensive damage in the crash. One of the drivers was pronounced dead at the scene. The other driver sustained minor injuries. Police conducted an investigation.

Impaired Driver Caused Crash

According to reports, one of the pickup drivers failed to stop at the red light and struck the other pickup truck in the intersection. The police noticed signs of impairment in the driver, who went through the red light. The driver was subsequently taken into custody. The driver was charged with felony death by motor vehicle. He is released on bond until his case moves forward in court. He may face additional charges.

Negligence in Car Accidents

A driver may be responsible for the injuries and damages they cause in an accident if they are found to be negligent. Negligence is the “failure to behave with the level of care that a reasonable person would have exercised under the same circumstances.” A person may seek compensation for damages caused by one’s negligence. A person may only obtain damages in situations where they themselves were not negligent. In this case, a relative of the victim may be able to file a claim for the wrongful death of their loved one.

Wrongful Death Claim

A wrongful death claim is a civil legal action against someone who negligently or knowingly caused the death of another. In many vehicle accidents, the negligent driver could be held liable for the losses that loved ones incurred as a result of their actions. Damages may include medical bills, compensation for funeral expenses, and money for loss of future income, as well as loss of consortium, among others. A wrongful death claim is a civil matter and is separate from any criminal charges the driver may face.

To be successful in a wrongful death claim, you must be able to prove that the person was negligent and that the negligence resulted in the wrongful death of another. It is important to note that a person does not have to have been found guilty of criminal charges in order to win a wrongful death claim.
