Common Home-Based Personal Injury Risks

Personal injury Lawyer Matt Arnold answers the question: “I was involved in a motor vehicle accident with injuries. Do I need a lawyer?”

A person’s home should convey a sense of comfort and safety from harm. However, there are many everyday items within a home that may cause a personal injury to inhabitants. Simple action steps can help mitigate these risks. Read on for information on some of the most common causes of home-based personal injury.

Slips and Falls

Slips and falls are a common cause of personal injury that occurs in a home. Individuals can slip and fall due to a number of hazards present in a residence, such as failing structural supports and safety devices (e.g. guardrails), water or other spills on the floor, unexpected behavior of pets, and trip hazards left on the ground by other inhabitants.

Cuts and Lacerations

An individual can suffer personal injury due to cuts due to many different scenarios. The risk of getting cut is often highest around areas of the home where sharp and dangerous equipment is present. In a typical American household, common risk areas for cuts include the kitchen and garage.

Although it may seem counter-intuitive, homeowners should keep knives sharp because it is easy for a dull knife to slip while cutting. In addition, knives should only be used on a cutting board and should not be carried around the kitchen to cut in different locations.  When not in use, knives and other sharp tools should be stored in a safe location.

Poison

Many household cleaning products contain ingredients that are poisonous to humans if ingested.  The risk of personal injury from poisoning is especially prevalent in young children, who are often prone to getting into anything in a home that is not blocked off. However, adults are also at risk for suffering significant personal injury due to poisoning from sources such as carbon monoxide in the home.

To mitigate the risk of poisoning, homeowners should ensure that cabinets are equipped with childproof locks. At least one carbon monoxide alarm should be installed on each floor of the home, including the basement if the home has one. These alarms should be regularly tested to ensure they are functioning properly.

Burns

Personal injuries resulting from burns are most common in the kitchen, but burns can certainly occur in other areas of the home as well. Machinery such as lawnmowers can become extremely hot and burn exposed flesh that it contacts. Even a hot water heater that is set too high can cause burn-related injuries to inhabitants.

When to Contact an Attorney

When someone suffers personal injury on another person’s property, the injured victim’s ability to successfully recover compensation for damages will depend on their legal team’s ability to prove that the homeowner’s negligence caused the injury. Homeowners have a duty of care with regards to the safety of anyone who enters the premises. When homeowners fail to take reasonable steps to make their home safe, they may be deemed negligent and liable in the eyes of a personal injury court.
